General Terms and Conditions

1. Validity of the Conditions

This is a list of the General Terms and Conditions, hereinafter referred to as “GTC”, of JFK Vermietung GmbH & Co. KG, Obotritenring 19, 19053 Schwerin, hereinafter referred to as Villa Backstein. These GTC apply from 01 January 2026.
The following GTC apply to the conclusion of an accommodation contract, which is automatically formed upon the provision of individual guest rooms as well as all related deliveries and services to the client, hereinafter referred to as the “Guest”. This also applies if no written contract is concluded and the accommodation is based on a verbal, written, remote, telephone or electronic (by e-mail) agreement between both parties.
The Guest acknowledges that any conflicting terms and conditions of the Guest shall not apply.

2. Conclusion of the accommodation contract

The booking/reservation of one or more guest rooms and other deliveries and services becomes binding for both parties upon written confirmation by Villa Backstein and the Guest. The applicable price list at the time shall be decisive. All services are otherwise subject to availability.
For individual reservations of guest rooms, the verbal declaration of intent by the Guest or the Guest’s representative shall also be sufficient.
If a deposit or advance payment is requested by Villa Backstein for a booking/reservation and this is not paid within the agreed deadline, the booking/reservation confirmation shall become void.
If the booking/reservation confirmation deviates from the content of the registration, the content of the booking/reservation confirmation shall become part of the contract unless the Guest objects without delay, at the latest upon acceptance of the services.
The house rules displayed on the premises also form part of the contract.

3. Conclusion of the guest accommodation contract

The applicable price list with the respective rates and service descriptions shall apply. All services and rates are otherwise subject to change.
The guest accommodation contract (accommodation contract) may be concluded in writing, verbally, by telephone or by conduct implying consent.
The conclusion of the guest accommodation contract obliges both contracting parties to fulfil the contract. In the case of overnight stays, the accommodation contract is deemed concluded as soon as the room has been ordered and confirmed or, if confirmation was not possible for time reasons, made available.

4. Price agreements and terms of payment

The agreed prices include value added tax (VAT), which is shown separately on the invoice. If VAT changes after the conclusion of the contract, prices shall change accordingly.
Agreed prices may be changed by “Ferienwohnungen Obo19” after the conclusion of the contract in accordance with the price lists valid at that time if the period between the conclusion of the contract and the provision of the service exceeds four months.
Unless expressly agreed otherwise, invoices are payable immediately upon receipt, without deduction and in cash.
Default on payment of even a single invoice entitles Villa Backstein to discontinue all further and future services for the Guest.

5. Liability

The Guest shall be liable for losses or damage caused by the Guest or their vicarious agents.
The Guest is obliged to notify Villa Backstein of the introduction of dangerous or illegal items (drugs, explosives, weapons, etc.).
In general, Villa Backstein shall only be liable for damages caused by gross negligence on the part of its vicarious agents.

6. Valuables

Villa Backstein expressly assumes no liability for the loss of valuables, in particular jewellery and cash.
The safekeeping of wardrobes, musical instruments, technical devices brought by the Guest and similar items is exclusively the responsibility of the Guest.
Access by third parties or the transfer of rooms of the guesthouse to third parties by Guests is only permitted with the written consent of the guesthouse.

7. Termination by the guesthouse

The guesthouse is entitled to terminate accommodation contracts (even after occupancy of the room(s)) with immediate effect and, in exercising its domiciliary rights, to expel the Guest or group of Guests from the premises if the Guest or group of Guests damages the reputation, security or standing of the guesthouse, is suspected of committing criminal offences, or harasses, repeatedly disturbs or endangers other guests, residents, passers-by or neighbours.
In particular, repeated violations of these GTC or the house rules displayed on the premises, as well as damage to, soiling of or theft of property belonging to the house, entitle Villa Backstein to immediate termination.
This also applies if the Guest uses the room or other areas of Villa Backstein for purposes other than those agreed.
In such cases, the Guest may be obliged to pay damages as well as the accommodation costs already incurred and the accommodation costs not yet incurred in accordance with the cancellation regulations under Section 8.
This shall also apply to all other accommodation contracts in cases of force majeure or the existence of another important reason within the mutually agreed cancellation conditions.

8. Cancellations

When booking/reserving guest rooms, Villa Backstein points out the option, cancellation and payment conditions as well as these GTC. These shall also be valid without a reconfirmation by the Guest.
Cancellations must be made in writing by fax or e-mail. Verbal or telephone agreements shall not be binding in the event of subsequent legal disputes.

Cancellation of a booking is regulated for both parties as follows:

• Cancellation more than 6 days before arrival: free right of withdrawal

• Cancellation less than 6 days before arrival: charge of the full booked service including cleaning costs

9. Arrival

Unless otherwise agreed by telephone, arrival of Guests shall take place between 3:00 p.m. and 7:00 p.m.
In the event of delays or changes to the arrival time, the service must be informed in good time and key handover coordinated.
The apartments must be vacated by 10:00 a.m. on the day of departure at the latest.

10. Other provisions

If the ordering party is a merchant, Schwerin shall be agreed as the place of performance and jurisdiction. Villa Backstein is, however, also entitled to bring an action at the place of residence of the ordering party.
These General Terms and Conditions and the contracts concluded on their basis shall be governed by German law.
Should individual provisions of these General Terms and Conditions for the conclusion of accommodation contracts be invalid, this shall not affect the validity of the remaining provisions. An agreement that comes as close as possible to the invalid provision shall apply instead.
Any deviations or ancillary agreements must be made in writing.
